1. WhizClassifieds.com acts as a venue for online users to post classified advertisements. WhizClassifieds.com is not involved in the actual transaction between buyers and sellers. As a result, WhizClassifieds.com has no control over the quality, safety, or legality of the advertisement posted, the truth, or the accuracy of the listings.

2. The user acknowledges that the sole obligation of WhizClassifieds.com is to display classified advertisements (Ad Displays), graphics, links, and/or banner advertisements from Advertiser which conform to the specifications set forth by WhizClassifieds.com. In this regard, the Advertiser agrees that (i) WhizClassifieds.com has the right to market, display, perform, transmit and promote the Ad Displays, and (ii) users of WhizClassifieds.com website have the right to access and use the Ad Displays and any content and/or services directly linked to the Ad Displays (the “Advertiser Web Content”).

3. Advertiser understands that once this advertisement agreement is executed, there shall be no refunds or pro-ration of rates or payments if the Advertiser elects to discontinue display of Ad Displays prior to the expiration of the advertising term. Notwithstanding the foregoing, WhizClassifieds.com may terminate this agreement if the Advertiser fails to pay any amount due hereunder and such nonpayment remains uncured for fourteen (14) days following notice to the Advertiser of nonpayment.

4. Orders are accepted subject to the terms and provisions of the current advertising rates. Advertising rates set forth in the rate card are subject to change; any rate changes will apply to any additional advertising services requested by the Advertiser after the such rate change. Currently, the advertising on WhizClassifieds.com is FREE.

5. The use of our services, website, materials, contents, and links herein is at your sole risk only and WhizClassifieds.com shall not be responsible for any loss or damage which results from the use or reliance or such services, business dealings, advertisements, promotions, views or opinions or any other materials, contents, and information not otherwise stated. Any materials or contents downloaded, copied, or otherwise obtained through the use of our services are done at your sole discretion and risk. You shall be responsible for any damage to your computer system or loss of data that results from the download or copy of materials from our website including any damages from computer viruses. Any changes made periodically to the website, materials, contents, and links may be made at any time without notice to you.

6. Our services, website, materials, contents, and links may contain mistakes, errors, inaccuracies, or typographical errors and typographical mistakes. Under no circumstances shall WhizClassifieds.com be liable to the advertiser for indirect, incidental, consequential, special, or exemplary damages (even if such damages are foreseeable, and whether or not WhizClassifieds.com has been advised of the possibility of such damages) arising from any aspect of the advertising relationship provided for herein. WhizClassifieds.com shall in no event be liable to the advertiser for more than the total amount paid to WhizClassifieds.com by the advertiser hereunder. WhizClassifieds.com makes no representations, and hereby expressly disclaims all warranties, express or implied, regarding WhizClassifieds.com’s services or any portion thereof, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from the course of dealing or course of performance. without limiting the generality of the foregoing, WhizClassifieds.com specifically disclaims any warranty regarding (i) the number of persons who will access the ad displays and (ii) any benefit advertiser might obtain from including the ad displays within WhizClassifieds.com’s website.

8. Without prejudice to the other provisions of this Terms and Conditions, WhizClassifieds.com may refuse, suspend, terminate, delete or amend any artwork, materials, information, or content of any data or information or posting, or refuse such data or information to be posted at this website if it is of the opinion and view that such posting is inappropriate for whatever reasons, to comply with the legal or moral obligations as placed on WhizClassifieds.com and to avoid infringing third party rights or any other rules, standards or codes of practices that may be applicable to the posting or on this website or the internet.

This Agreement sets forth the entire agreement between Advertiser(s) and WhizClassifieds.com, and supersedes any and all prior agreements (whether written or oral) of WhizClassifieds.com Advertiser(s) with respect to the subject matter set forth herein; provided. This Agreement shall be interpreted, construed, and enforced in all respects in accordance with the laws of Singapore, without regard to the actual state or country of incorporation or residence of the Advertiser(s). Advertiser(s) hereby irrevocably consents to the exclusive jurisdiction of the courts of Singapore with any action arising under this Agreement. Advertiser(s) may not assign this Agreement, in whole or in part.
